OVERVIEW
Downtown San Diego continues to be an area filled with high-rise offices, residences and retail businesses, along with amenities attractive to many visitors. As a result, there is a scarcity of affordable covered and secure parking facilities for County-owned vehicles and safety equipment within proximity to the Hall of Justice. The amount of available parking at the Hall of Justice is inadequate to satisfy all the District Attorney’s parking needs.
To meet the need for secure and covered parking within relative proximity, the District Attorney’s Office has identified the ACE Parking Inc. parking garage on Columbia Street as a safe environment to park County-owned law enforcement vehicles. ACE Parking Inc. is the only service provider that can continue to accommodate the estimated 200 parking spaces required. Pursuant to Board Policy A-87, Competitive Procurement, procurement of secure parking spaces from ACE Parking Inc. qualifies for single source since the unique service is not available from other sources.
This is a request to authorize the Director of Purchasing and Contracting to enter into a one-year contract with four (4) option years, beginning on July 1, 2025, through June 30, 2030, with ACE Parking Inc. to continue providing an estimated 200 covered and secure parking spaces at the Columbia Street parking garage on behalf of the District Attorney’s Office. The current contract expires June 30, 2025.
RECOMMENDATION(S)
DISTRICT ATTORNEY
1. In accordance with Board Policy A-87, Competitive Procurement, approve and authorize the Director of the Department of Purchasing and Contracting to enter into negotiations with ACE Parking Inc. and subject to successful negotiations and a determination of a fair and reasonable price, award a contract(s) for secure parking spaces within a five-block radius of the Hall of Justice, for one (1) year and four (4) option years beginning July 1, 2025 through June 30, 2030, and an additional six (6) months if needed, and to amend the contract(s) as needed to reflect changes to services or funding subject to the approval of the District Attorney.

Today’s action will permit the District Attorney’s Office to meet its operational needs and continue pursuing equal and fair justice for all San Diego communities.
SUSTAINABILITY IMPACT STATEMENT
The proposed action supports the County of San Diego’s Sustainability Goals of a fair and equitable justice system. The District Attorney's Office’s use of secure and proximity parking allows for a timely response to the community’s law enforcement needs, contributing to overall regional sustainability.
FISCAL IMPACT
Funds for this request will be included in the Fiscal Year 2025-26 CAO Recommended Operational Plan for the District Attorney’s Office. If approved, this request will result in estimated costs and revenue of $400,000 in Fiscal Year 2025-26 and estimated costs and revenue of $400,000 in Fiscal Year 2026-27. The funding sources are revenue from various State grants and programs, including Proposition 64 Consumer Fraud, Insurance Fraud, and the Computer and Technology Crimes High-Tech Task Force ($116,000), and General Purpose Revenue ($284,000) in each fiscal year. There will be no change in net General Fund cost and no additional staff years.

BACKGROUND
Downtown San Diego continues to be in short supply of covered, secure parking spaces and available monthly parking options. Development of office space, high rise housing, and retail space has increased the demand and decreased the supply for downtown parking. Security concerns have prompted many garages to limit parking access to tenants only. And surface lots allocate fewer monthly parking spaces or eliminate them all together, allowing companies to earn increased profits through hourly parking. In addition, surface lots do not provide security for County-owned vehicles, nor the safety equipment stored in them.
District Attorney Investigators, who operate the vehicles, make an average of three out-of-office trips per day. Occasionally, other employees are also required to make out of office trips. To minimize the investigators’ nonproductive time costs, parking must be within relative proximity to the Hall of Justice.
On January 14, 2020 (5) the Board of Supervisors authorized the single source procurement with ACE Parking Inc., formerly ABM Parking Services, to meet the District Attorney’s need for parking within proximity to the Hall of Justice. The District Attorney’s Office continues to require secure and covered parking spaces for County-owned law enforcement vehicles in Downtown San Diego. The ACE Parking Inc. facility on Columbia Street was determined to be the only location that can accommodate the estimated 200 parking spaces required and meets A-87(1)(D)(3), procurement for services from a provider with a unique ability not available from other sources.
If approved, today’s action will authorize the Director of Purchasing and Contracting, to enter into a one-year contract with four (4) option years, beginning on July 1, 2025, through June 30, 2030, with ACE Parking Inc. to continue fulfilling the parking needs of the District Attorney’s Office. This will renew the current contract that expires on June 30, 2025.
