AMENDMENT TO THE SERVICES AGREEMENT BETWEEN THE COUNTY OF SAN DIEGO AND THE SAN DIEGO COUNTY AIR POLLUTION CONTROL DISTRICT (DISTRICTS: ALL)

OVERVIEW
California Assembly Bill 423 (Gloria, 2019) amended the California Health and Safety Code to require the composition of the San Diego County Air Pollution Control District (SDAPCD) Board to include County, City, and public members. As a result, the SDAPCD ceased to be part of the County of San Diego (County) organizational structure on March 1, 2021. On August 5, 2020 (14), the Board of Supervisors authorized the execution of a services agreement between the County and SDAPCD to specify the services to be provided by the County, including limited services in the County’s Oracle financial system until July 1, 2022. On April 6, 2021 (29), the Board of Supervisors authorized the amendment of the services agreement for changes relating to fleet management services, indemnity and insurance. On February 8, 2022 (6), the Board of Supervisors authorized a second amendment of the services agreement to extend limited services in the County’s Oracle financial system until July 1, 2025.
Today’s proposed action would authorize the County of San Diego to continue to provide SDAPCD with limited services in the County’s financial system throughout the term of the agreement and authorize the Chief Administrative Officer to amend the agreement between the County and SDAPCD to reflect this change along with other revisions to various agreement sections to eliminate outdated provisions and clarify roles and responsibilities of both parties.
RECOMMENDATION(S)
CHIEF ADMINISTRATIVE OFFICER
1. Authorize the Chief Administrative Officer, or designee, to execute an amendment to the services agreement (Attachment A) between the County of San Diego and the San Diego County Air Pollution Control District to continue the County’s limited services in the County’s financial system throughout the term of the agreement along with other revisions to various agreement sections to eliminate outdated provisions and clarify roles and responsibilities.
EQUITY IMPACT STATEMENT
The San Diego County Air Pollution Control District’s (SDAPCD) mission is to improve air quality to protect public health and the environment. This is accomplished through engineering, monitoring and technical services, compliance, rule development, and grants and incentives divisions. It is anticipated that, by continuing to provide limited services to SDAPCD through the County’s financial management system, the SDAPCD will continue to provide the public with critical services while maintaining and improving effective operations that benefit the health and wellbeing of communities throughout San Diego County.
SUSTAINABILITY IMPACT STATEMENT
The recommended actions support the County of San Diego’s Sustainability Goal # 4 to protect the health and well being of everyone in the region by protecting indoor and outdoor air quality by advancing policies, programs and services to improve air quality to protect public health and the environment.
FISCAL IMPACT
There is no fiscal impact as a result of today’s requested action. If approved, the amendment to the Services Agreement will not result in a change to the service level. There will be no change in net General Fund costs and no additional staff years.

BACKGROUND
On August 5, 2020 (14), the Board of Supervisors (Board) approved the execution of a services agreement between the County of San Diego (County) and the San Diego County Air Pollution Control District (SDAPCD) to set forth the arrangement for performance and payment of services provided by the County. The agreement addresses the County services provided to the SDAPCD by departments including the Auditor & Controller, Human Resources, General Services, County Counsel, and Purchasing and Contracting, and specifies the payment mechanisms for those services. On April 6, 2021 (29), the Board of Supervisors authorized the amendment of the services agreement for changes relating to fleet management services, indemnity and insurance. On February 8, 2022 (6), the Board of Supervisors authorized a second amendment of the services agreement to extend limited services in the County’s Oracle financial system until July 1, 2025.
Among the services provided by the County under the current agreement are limited services and access to reports and information in the County’s Oracle financial system through July 1, 2025. County and SDAPCD staff have determined that it is in the best interests of both parties to eliminate the termination date for these services to ensure that SDAPCD has continued ongoing access to essential financial reports and services in the County’s financial system, as procurement and implementation of a new financial system for SDAPCD would be cost prohibitive and present numerous feasibility challenges for both parties.
Today’s proposed action would authorize the Auditor and Control to continue to provide limited services and access in the County’s financial system, as described in the services agreement, to the SDAPCD throughout the term of the agreement. The proposed action would also authorize the Chief Administrative Officer to amend the services agreement between the County and SDAPCD to continue these services and make additional revisions to various sections to eliminate outdated provisions and clarify the roles and responsibilities of both parties.
LINKAGE TO THE COUNTY OF SAN DIEGO STRATEGIC PLAN
Today’s proposed action supports the Sustainability and Empower initiatives in the County of San Diego’s 2025-2030 Strategic Plan by aligning the County’s available resources with services to maintain fiscal stability and ensure long-term solvency, and investing in our workforce and operations by providing support services and excellent customer service to ensure continuity of operations remains at its best.
